I was a trading assistant for someone on ebay and listed Your Baby Can. The listing was suppose to be up for a week but 20 hours after it was removed my Vero. I have not had a chance to sell one. And I was being paid commission minus listing fees, and paypal fees to list this product for someone. Now I've received an email from Johnson & Pham requesting $900 plus I need to give them my inventory, how much I sold, profits I made, etc. I contacted the person I was selling for and he reassures me that they are not counterfeit. But he does not have any documentation to prove. Do I need to get a lawyer? What's the worst that can happen to me since I was being paid to sell for someone?

I just received a letter from that ****ing Johnson & Pham, LLP asking $15K because 6 boxes wre seized by customs. i received a court complaints and asking money. Please help me and I really need the technical support from you badly.

When you receive one of these cease and desist letters, the RIGHT approach using tech support will ensure that you get out of the situation without having to pay anything, AND avoid liability.

These corporations, including Johnson and Pham, are still at it. If you are contacted by any company with a cease and desist letter, you need tech support to avoid liability.

I am a desperate, Ebay silver seller, Top rated,
a while ago my husband acquired about 200 photos of an older porn star from the store in NY that was closing down.

Well, a VERO member claims the copyrights to those photos, of course ebay closed our account for 7 days.

I contacted the alleged copyrights owner, ( in a very professional manner) and asked him to provide me with the VA numbers.
in response, I received a bunch of BS, and threats that he is going to close my account, that he is VERO member, etc, The emails were extremely unprofessional.

I checked with the copyrights office, and that person/company DO NOT own any copyrights ( even dough in the first response, I received he claims that he is a registered copyrights owner)
And to my total amusement when I called ebay - to obtain some proof of the copyrights i.e.VA number, I was informed that Ebay only requires a sworn statement of the copyrights owner, A joke?
That particular porn star has close to a million photos taken. Any idea how to deal with this?
I can not afford to have my store closed, I invested around 10,000 for resale ( antiques, toys, etc)

Well the problem is that when it comes to VERO issues, and to some degree all Ebay issues, the policy is to shoot sellers first and ask questions later. It's better to learn how to fly under the radar and sell VERO without problems, although if you're selling a highly unique item such as you describe, there is not much you can do - at least not right away - if someone with VERO connections to Ebay decides to target you.

But there is a lot you can do, over time, to defend yourself and come back up on top.

I gotta tell you, Modee saved my ass to the tune of over $14,000 bucks. I was selling some bootleg P90x cd's on ebay, and little did I know one of the people who bought one was an attorney from a company called "Johnson and Pham". It was an associate there and he used his home address. These ****ers send me a lawsuit demanding $14K, or else if they win they can get 3x that and maybe even jail time. I was literally ****ting a brick because they had me "red handed" selling counterfeit ****.

I had done some business in the past with Modee and he was amazing so I emailed him and presented my case. He emailed me back and man was I revealed. He laid out the different possible scenareo's that these law firms come after you with, and of course mine was the worse because I had actually sold counterfeit product to them directly.
