How can they justify this?

Not on all categories yet (but it will be). Another way to grab FVF on your would be shipping fees.

The requirement affects selected categories in Video Games, Mobile & Home Phones, Consumer Electronics, Computing, Photography, and Clothes, Shoes & Accessories.

All that really seems to be changing there is that now EBAY, like PayPal, will introduce a customer service rep. into the mix for not delivered, not as described, etc. claims, rather than the current automated method. I suppose it will be an improvement over the current EBAY method where no one even looks at the comments posted, and unless the buyer withdraws the complaint it remains as a black mark against the seller.
