EBAY is sued - why not iofffer for trademark issues

Probably because EBAY purports to exert CONTROL over their forum. Any forum where the members are allowed to run wild and do whatever (e.g. ioffer), is more of a distributor of content versus a publisher (who exercises control over its content).

Case has held that publishers can he held liable for content, but not mere distributors.
